Denver Colorado Estate Planning Legal Help

Medicaid Planning - Guardianships - Estate Planning

At the Law Office of Paul Mitchell, LLC, based in Aurora, Colorado, we represent clients throughout the Denver Metro area. Established in 1997 by elder law attorney Paul Mitchell, our law firm provides individuals and their families with experienced legal help in the following practice areas:

Medicaid Planning
While proactive planning gives people peace of mind and financial protection, the failure to make a plan that bolsters one's Medicaid eligibility may result in future financial hardship for elders and their family members. We advise our clients to carefully consider their eligibility for Medicaid long before they will need it and take prudent legal steps that will pay off later in life. We counsel clients on asset structuring, asset planning, the spend-down process, passing down of counted and uncounted assets, creation of a gift plan to family members, and the choice of an appropriate Medicaid-qualified annuity. With proactive Medicaid and asset protection planning you can maximize the amount of assets available to your spouse. In addition, the IRAs of both spouses can also be protected through proper planning, so that they do not need to be cashed in prematurely.

Guardianships
We assist clients and their family members in establishing conservatorships to protect elders from being neglected and from financial exploitation. Elders are vulnerable to such exploitation because of disabilities, both physical and mental, that are associated with aging. If necessary, we can direct clients to other professionals who specialize in healthcare management and other such services. Our law firm can also help your family construct a plan for crisis planning and crisis management.

We handle conservatorship cases involving family members who are abusing the power of attorney they were given, and we have significant experience dealing with con artists who exploit the elderly. The areas of refusal of care, self neglect, and financial abuse and exploitation of the elderly are well within the scope of our practice.

Estate Planning
We help individuals of all ages establish proactive and comprehensive estate plans including the creation of wills, trusts, durable powers of attorney, living wills and living trusts, among others. We can help you preserve and protect the assets of your estate as they are passed on to family members and distributed according to your final wishes. Our law firm will assist you in examining your legal options by discussing what is best for you and your family.
